About this course

When an employee, student, or other member of your organization reports sexual misconduct, how do you conduct a fair, thorough, and legally sound investigation?

Sexual misconduct complaints are among the most sensitive and complex matters investigators can face. Whether arising in a workplace, university, college, or other institutional setting, these investigations require specialized knowledge, strong interviewing skills, and an understanding of the unique dynamics that can affect reporting, memory, trauma, credibility, and decision-making.

This hands-on, advanced-level course is designed for investigators, HR professionals, student affairs staff, EDI practitioners, labour relations professionals, and others who may be responsible for receiving, responding to, or investigating such complaints.

While sexual harassment and sexual violence may impact individuals differently, there are common physical, emotional, psychological, and organizational effects that investigators must understand. The response of an employer, educational institution, or other organization can significantly influence both the experience of the parties involved and the broader organizational climate.

Participants will gain a deeper understanding of the legal and practical issues involved in investigating allegations of sexual harassment, sexual violence, and other forms of sexual misconduct. Through discussion, case studies, and experiential learning, participants will develop the confidence and skills needed to conduct investigations that are fair, trauma-informed, and procedurally sound.

Testimonials

Participating in the sexual misconduct investigation training has been a transformative experience for me professionally. One of the key learnings was the importance of planning questions ahead of time, which has allowed me to conduct interviews more effectively and systematically. The training also emphasized maintaining an empathetic yet neutral demeanour throughout the investigation process—a crucial skill for handling sensitive cases fairly and respectfully.

Furthermore, the emphasis on meticulous documentation has improved my ability to record and manage information accurately, ensuring a clear and transparent investigation process. The training gave me a deeper understanding of how to interpret the balance of probabilities based on evidence, which is a critical aspect of making informed decisions. Lastly, it deepened my comprehension of consent as a legal concept, an essential element in sexual misconduct cases. These skills have enhanced my ability to conduct thorough investigations and contributed significantly to fostering a safer, more respectful work environment
